Burke County
Articles of Agreement between Wiley M. Pope
of the County of Washington and State aforesaid
of the one part and Mrs. Mary Ann Skinner of the
County of Burke and same State of the other
part. Witnesseth that whereas there is a
marriage contract soon to take place between the
above named persons and as they both have
children and are both in possession of some real
estate they have thought proper to make and
enter into this article previous to marriage.
First that they will put what property it has
pleased God to give them together both real and
personal and use it for their own material
comfort and benefit during their natural
lifetime and Second that their marriage together
shall not change the ownership or possession of
each estate in any wise whatever. Third that
they do by this agreement reserve to themselves
and for themselves the right of bestowing what,
or all real estate they may have at the time of
intermarriage as they may think best when they
come to die. And in the event either of them
should die without exercising such right the
survivor is bound according to this agreement to
turn over unto the hands of their child or
children or their heirs all such real estate as
they may know or believe to have been the wish
or intention of the deceased. They further
covenant and agree to appoint Jesse Scaptrott to
act as their trustee and see that the spirit of
this article is carried out and that we do
mutually request said trustee in case of waste
on either part to interfere and make good such
waste out of the others estate. And that this
article be recorded in the Clerks Office of the
respective County and remain a living witnesss.
